DURING SALES SERVICES

In addressing the realities of the workplace, SDE routinely work with and assist our clients to address personnel issues of workers which might affect the functioning of business operations, SDE have extensive experiences in all aspects of recruitment including:

 

  • SDE shall provide consultancy services pertaining to the recruitment of foreign workers.

 

  • SDE shall provide assistance for the preparation and submission to Ministry of Internal Home Affairs (KHEDN) and/or Immigration Department for the Approval. 

 

  • SDE shall provide assistance for the submission of Foreign Workers work permit (Entry Visa) and all related Immigration Department Affairs.

 

  • SDE shall provide assistance in the preparation of documents and endorsement to and from various government departments.

 

  • SDE shall provide assistance in arranging for the deployment of workers to Malaysia.  

 

  • SDE shall provide Interpreters and counselors services to enhance after- sales commitment and to resolve any matter involving the Foreign Workers, being misunderstanding or disputes over work or money.

AFTER SALES SERVICES

In view of the current recruitment scenario, SDE is well aware of the need to ensure that the employment of foreign workers, not only done solely by recruiting the workers to make the numbers at a factory or a job site but there will be numerous matters that need dueconsideration. SDE operation department has the experience to resolve the problems faced by many employers concerning foreign workers. 

 

Firstly, SDE will be ready to dispatch its team to try to resolve any dispute involving the foreign workers.

 

Secondly, SDE have engaged foreign worker’s counselors and representative as part of customer service care team in resolving foreign workers matter. These foreign counselors are sent by the recruitment agencies from our foreign counterparts to assist their recruited foreign workers in addressing their concerns and to understand their requirement as an employee.

 

Thirdly, SDE will pay a visit on a regular basis to the jobsite to ensure that both employers and employees are satisfied with their roles and responsibilities. SDE shall in advance request for the permission to pay a visit in order to maintain the close relationship with its clients.

  1. What is the normal process taken for recruitment of workers?

        The entire process takes approximately 2-4 months which includes:

  • Application to the Labour Department of Malaysia   2- 5 weeks

  • Selection of Candidates

  • Orientation of workers for Certificate of Eligibility (C.E) (where applicable)

  • Application to Ministry of Internal Home Affairs (KHEDN) 2-4 weeks for approval

  • Attestation from relevant authorities 4 weeks 

  • Application to Immigration Department  for Calling Visas 7-14 days 

  • Processing of entry visas and Approval from Source Country Ministry of Labour 2-4 weeks         Entry of workers 3 weeks

 

 

  1. On training of workers for overseas job recruitment.

   In order to qualify to work overseas, labourers need to study the followings: 

  1. Orientation on various knowledge aspects related to their works such as: 

    1. Rights, obligations and legal responsibilities of labourers in executing all commitments undertaken in contract.      

    2. Contents of contract signed by enterprise towards labour, responsibilities of labour to enterprise, responsibilities of labours to the state.

    3. Discipline and industrial working style, various regulations & norms on the safety of labor in the factory, collective farm, and all forms of transportation. 

    4. Numerous of regulations related to labour law, criminal law, civil law, immigration law & place of residence of source country and of the receiving labour country.

    5. Customs, manners, working conditions and daily life, conduct of relationship between the employer and the worker in the receiving nations, experiment in communications. 

 

  1. Learning and upgrading one's vocational in accordance with contract supplying labors with each respective country. 

  2. Learning foreign languages to satisfy requirement on country receiving labors (in accordance with Contract) 

 

 

3.          On the employment contract after completion or in the event of breach: 

               

  1. After completing contracts, thus returning home, the labors need to execute procedures of discharge contract with the employers. The content of discharging contract include: social insurance, settling all accounts relating to employers and the labors, executing resend the labors home and carry out all policies, regulations (if any) in accordance with the contract and the state. 

  2. If breach of contract causes damage to the employer engaging the labors and the labor exporting enterprise, the all amounts concerned will be deducted from deposits, collated in accordance with legal provision. In addition, the labor must compensate for all damage arising from breach of contract by him/her and bear all other punitive measures required by the law. 

 

 

4.          On application documentations

             Documents of labour going to work overseas include: 

a.          Documents in accordance with general requirement covering: 

  1. Petition to attend selection for work overseas with limited time-frame. 

  2. C.V. with attestation of people's Committee, the commune, quarter, small town,  III. Place of permanent residence of unit for  management of human affairs.

  1. Certificate of good health with conclusion of hospital which the enterprise has signed a contract as required.

  2. Contract of overseas employment with labor export enterprise. 

Documents in accordance with contractual requirements of overseas employers possibly including: 

 

  • Certificate for Skilled. 

  • Certificate for non criminal 

  • Certificate of Eligibility

 

 

5.    Expenses incurred by labors when working overseas 

 

  1. Expenses needed to compile the documents and undertake the various Immigration procedures in accordance with the current state regulations (includes passport, visa). 

  2. Expenses for health examination at the level required by the Ministry of Health. 

  3. Recruitment service fee. 

  4. Deposit (After home repatriation after completion of contract) 

  5. Social insurance. 

  6. Airfare ticket costs from source country to employer's country (except the case that employer

provide free). 

  1. Agent commission for all overseas recruitment agencies. 

 

 

6.    On labour recruitment by Vietnamese state-owned companies/other foreign companies  

 

  1. According to the current state regulation on the selection of overseas labor, the state companies via SDE must first have an agreement with the potential overseas employers of the labours stating number of labours to be selected, trade structure, gender and various conditions. Before selection, the state companies must register the contract with the Ministry of Labour and Social Affairs. 

  2. When selecting, the state companies must announce at its headquarter and the local place of selection, all requirements on gender, age, work which the labors must assume responsibility for, place of work and limited time frame of the contract; conditions of work and living condition; salary, wages, all payments needed to be. 

  3. The state companies will directly select the labours and after 5 days from the day's selection, the enterprise must announce the result to the labours. 

  4. The state companies must announce to the labors the plan for bringing the labor to work overseas. In the case where it is not possible to follow such plan, it must be announced clearly to the labors the reasons therefore.
